Website and Client Terms of Service

1. About These Terms

These Terms govern both your use of the ProGenMatch website at www.progenmatch.com (the “Website”) and, where applicable, your use of our genealogist matching service (the “Service”).

By accessing the Website or submitting a research request, you agree to be bound by these Terms. If you do not agree, please do not use the Website or the Service.

The Website and Service are operated by ProGenMatch (“we”, “us”, “our”), a trading name of Gemma Ward, trading address of 61 Bridge Street, Kington, HR5 3DJ. We are based in the United Kingdom.

2. Using the Website

2.1 Permitted Use

You may use the Website for lawful personal or business purposes. You agree not to:

  • Use the Website in any way that breaches applicable local, national or international law or regulation;

  • Use the Website fraudulently, dishonestly, or for any unlawful purpose;

  • Transmit unsolicited or unauthorised advertising or promotional material;

  • Knowingly transmit data or upload material containing viruses, trojans, worms or other harmful code;

  • Attempt to gain unauthorised access to any part of the Website or its related systems;

  • Reproduce, duplicate, copy or resell any part of the Website without our permission.

 

2.2 Website Availability

We do not guarantee that the Website will be secure, free from bugs or available at all times. We may suspend or restrict access for business or operational reasons and will try to give reasonable notice where possible.

2.3 Intellectual Property

All content on the Website - including text, graphics, logos, images and software - is owned by or licensed to ProGenMatch and protected by UK and international intellectual property laws. You may print or download content for personal use only. You must not use any Website content for commercial purposes without our written permission.

2.4 Third-Party Links

The Website may link to third-party websites or services. We do not control those sites and are not responsible for their content or privacy practices.

3. The Matching Service

​

3.1 What ProGenMatch Does

ProGenMatch operates as a matching and introduction service only. Our role is to:

  • Receive and review your research request;

  • Identify and introduce you to a suitable qualified genealogist from our network;

  • Facilitate initial contact between you and the matched genealogist.

ProGenMatch does not itself carry out genealogy research. Once introduced to a genealogist, any research engagement is a direct contractual relationship between you and that genealogist.

3.2 Free Service

The matching service is provided to you free of charge. ProGenMatch does not charge clients for introductions.

3.3 No Guarantee of Match

Whilst we will use reasonable endeavours to find a suitable genealogist, we cannot guarantee that a match will always be available or that a matched genealogist will be able to take on your project.​

3.4 Accuracy of Your Request

You agree to provide accurate, honest and complete information when submitting a research request. We accept no liability for outcomes resulting from inaccurate information you provide.

3.5 Timescales

Timescales indicated on the research request form relate to when research begins, not when findings will be delivered. Research duration depends on the scope of the project and is agreed directly between you and your genealogist.

4. Your Relationship with the Genealogist

Once we introduce you to a genealogist:

  • Any contract for research services is formed directly between you and the genealogist;

  • The genealogist’s own terms and conditions govern the research engagement;

  • Fees, timescales, deliverables and dispute resolution are matters solely between you and the genealogist;

  • ProGenMatch is not a party to that contract and accepts no liability in respect of it.

You should obtain and review the genealogist’s terms before engaging their services.

5. ProGenMatch’s Liability

5.1 Limitation of Liability

ProGenMatch’s liability to you is limited to the direct losses you suffer as a result of our breach of these Terms or our negligence. We shall not be liable for:

  • Any loss or damage arising from your use of, or inability to use, the Website or its content;

  • The quality, accuracy or outcome of any genealogy research carried out by a matched genealogist;

  • Any dispute between you and a matched genealogist;

  • Loss of opportunity, loss of profits, or any indirect or consequential loss;

  • Any loss arising from inaccurate information you provided in your request.

5.2 Nothing Excluded

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited by law.

6. Conduct

You agree to behave professionally and respectfully in all communications through or facilitated by ProGenMatch. We reserve the right to withdraw access to the Website or Service to anyone who engages in abusive, harassing or unlawful conduct.

7. Data and Privacy

Your personal data will be handled in accordance with our Privacy Policy, available at www.progenmatch.com/privacy. By submitting a research request, you consent to the processing of your personal data as described therein, including sharing your contact details and research brief with a matched genealogist.

8. Amendments

We may update these Terms at any time by posting a revised version on the Website. Your continued use of the Website or Service after changes are posted constitutes acceptance of the updated Terms.

9. Governing Law

These Terms are governed by the laws of England and Wales. The parties submit to the non-exclusive jurisdiction of the English courts, without prejudice to the rights of users in Scotland to rely on Scots law where applicable.

If you are accessing our services from outside the United Kingdom, you do so on the basis that these Terms are governed by English law and you submit to the non-exclusive jurisdiction of the English courts.
